Gearbox, covered under warranty?

So last night, my car brokedown. 

Recovery "Agent" came out and said it was a gearbox bearing and couldn't be fixed at the side of the road. 

Is this covered under the warranty?

2010 Kia Magentis
56k miles 2.0crdi

Last serviced 44k miles (booked in at my garage to be serviced at the end of the month)

How long is the warranty on the Magentis and how big is the service interval? 22,000 since the last service seems a long time! If its still in force then I should think you are covered. How can they wriggle out of replacing a knackered gearbox unless you have breached the terms?

with used car warranty it is very important that the services are done within one month or 1k miles of the recommended mileage, if you have just got the car they might not cover the bearing because it will have been like that when you got it,

Service book says every 12500 miles.
It's still in warranty (magentis has 7 year warranty)

Car has been taken by the dealer, they won't get a look at it until tomorrow.
